Makati court formally takes over Subic case

THE Makati City Regional Trial Court on Friday formally received the case against four American Marines accused of raping a Filipina in Subic.
The case was received by Executive Judge Sixto Marella Jr. of Branch 138. Marella ordered the raffling off of the case for April 3, at 1:30 p.m.
The case was supposed to have been raffled off to an Olongapo City Regional Trial Court, which has jurisdiction over the Subic Freeport, but the Supreme Court allowed the venue to be changed after a motion was filed by the victim and the Department of Justice.
The motion requested the transfer of the case to Quezon City, but the Supreme Court said the Makati Regional Trial Court had a lower caseload.
The Makati RTC has a total of 30 courts and 11 are either family courts, illegal drugs courts, or courts with no assigned judges.
Judge Renato Dilag of the Olongapo RTC was originally assigned the case but later recused himself, saying that his son had worked with the law firm that represents one of the accused.
Accused Daniel Smith, Keith Silkwood, Dominic Duplantis and Chad Carpentier are in the custody of the US Embassy
