SBMA bows as court scraps exclusive use of Subic port
Cargo handlers using the Port of Subic have lauded the Subic Bay Metropolitan Authority (SBMA) for honoring the court decision disregarding the exclusive use of Boton Wharf, and allowing free enterprise in the freeport zone.
SBMA Chairman Feliciano Salonga said that Boton Wharf, designated for cargo handling and unloading of fertilizers from ships, was granted exclusive use of Subic Seaport Terminal, Inc. (SSTI).
"There used to be an existing contract between SBMA and SSTI which gave SSTI an exclusive use of Boton Warf for unloading fertilizer," Salonga said.
He added that the exclusivity was nullified by Judge Ramon Caguioa of Branch 74 of the Regional Trial Court in Olongapo City, because the arrangment negatively affects the public interest.
"The exclusive right granted to SSTI amounts to a combination in restraint of trade or unfair competition because there is no public interest enhanced by reason of such exclusivity," Caguioa said as quoted from his three-page decision. (Franco G. Regala -Tempo)
