Tax row between Clark firm, town resolved

MABALACAT -- "All is well that ends well." Thus said by Mayor Marino Morales on Tuesday as he disclosed that the tax dispute between the Municipal Government and Clark Development Corporation (CDC) was already settled.
Morales said talks were already made between him and the CDC officials led by president Antonio R. Ng regarding the matter Tuesday noon. "What we will do now is push for the passage of the amnesty bill if only to resolve the impasse," he said.
The bill seeks to provide tax incentives to locators inside the Clark Special Economic Zone (CSEZ) and the amendment to Republic Act (RA) 7227 or the Bases Conversion Development Act.
Morales, last Monday, ordered the deferment of the Municipal Government's collection of taxes to over 350 foreign and local investors inside the ecozone, considering the pending resolution of the motion for reconsideration lodged by the CDC with the Supreme Court (SC) as regards the tax incentives of locators.
He added he will refer the matter to lawyer Pepito Torres, the town's legal officer, and will seek legal opinions from government owned and controlled corporations (Goccss) and the Department of Justice (DOJ) on the issue.
The SC earlier declared Section 5 of Executive Order (EO) 80 null and void canceling all incentives and tax exemptions of locators in the Clark ecozone.
With this, the Municipal Government initiated a tax collection scheme to increase its revenues. The Municipal Council has authorized, through Resolution No. 634, Municipal Treasurer Angelito Pelayo to impose and collect applicable taxes and fees to business establishments in the CSEZ.
The mayor said Clark locators should now secure mayor's permits and building permits and start paying business taxes.
The local government units (LGUs) around the Clark ecozone are getting at least one percent of the total Gross Income Earned (GIE) of the Clark ecozone. About 90 percent of Clark ecozone fall in the territorial jurisdiction of Mabalacat town, now a first class municipality vying for cityhood status
