SC orders Malacañang to explain Smith transfer

The Supreme Court on Tuesday ordered Malacañang to explain the transfer of a US marine convicted last year for raping a Filipina, ABS-CBN News reported.

The report said the High Court has demanded an explanation from Executive Secretary Eduardo Ermita, Foreign Affairs Secretary Alberto Romulo, Justice Secretary Raul Gonzalez and Interior Secretary Ronaldo Puno in connection with the transfer of Lance Corporal Daniel Smith.

The Court’s order was in response to the petition filed by Evalyn Ursua, the private lawyer of the victim identified only as "Nicole."

In a 26-page petition, Ursua asked the Court to nullify a written agreement between US Ambassador Kristie Kenney and Romulo on December 19 authorizing the transfer of Smith back to the custody of the American embassy in Manila.

The victim's camp also asked the Court to issue a warrant of arrest against Smith after he was transferred his detention cell at the Makati City Jail to the US embassy on December 29.

Smith was sentenced to life imprisonment on December 4 last year after Judge Benjamin Pozon of the Makati Regional Trial Court found him guilty of raping Nicole inside the Subic Bay Freeport, Zambales, on Nov. 1, 2005.
