‘We’ll go to UN if verdict on Subic Rape reversed’ - TASK FORCE SUBIC
The women's organization keeping watch on developments in the Subic rape case said they will take the case to the United Nations if the Court of Appeals overturns the decision of the Makati City Regional Trial Court convicting Lance Corporal Daniel Smith.
"As the decision from the Court of Appeals is expected to be released, we are more vigilant,” Task Force Subic Rape member Esperanza Santos said in a statement released in reaction to reports the appellate court might reverse the decision against Smith, a US Marine lance corporal who was found guilty last December of raping a Filipinas inside Subic Bay Freeport and sentenced to 40 years in jail.
Three of Smith’s co-accused, also Marines, were acquitted of the charges.
Despite the guilty verdict, the national government allowed Smith to be taken from the Makati City jail and handed over to the US embassy for custody until the appeals process on his conviction.
“Once the Court of Appeals acquits Smith, Nicole would no longer have any recourse but to bring the case to the United Nations," Santos said in the statement.
The Task Force has consulted UN Special Rapporteur on Violence Against Women (VAW) Dr. Yakin Ertuk on the Subic rape case.
The Court of Appeals is expected to release its ruling on Smith within this month.
The case was assigned to Associate Justice Agustin Dizon, who is due to retire on June 27. By Tetch Torres - INQUIRER.net
