Ex-actor sues resort owner for libel, estafa

OLONGAPO CITY -- A Filipino-American Super Lotto winner-turned businessman is now on the DoJ’s watch list after a former local movie matinee idol filed libel and criminal charges against him. Atty. Noel Atienza, legal counsel of former matinee idol Kenneth Peralta, confirmed that Rolando Gipulan, who has dual citizenzhip and president of Punta de Uian Resort Hotel in San Antonio, Zambales, has paid a P20,000 bail for his temporary freedom.

The 57-year-old Gipulan won the $44-million jackpot in the California lottery Super Lotto Plus in 2005. He got $19.2 million after choosing the cash-value option plus tax deductions. Peralta told reporters that he filed libel case against Gipulan, who called him a “thief, a swindler and congenital liar” on November 4 and 25, 2007, over GMA-7’s Showbiz Central show.

A warrant of arrest was issued against Gipulan on May 28. Peralta, who has worked as Tourism Manager of Subic Bay Metropolitan Authority, was hired by Gipulan to be the managing director of Punta de Uian on January 1, 2007 until his resigned on August 31 of the same year. On June 2007, Peralta spent P185,000 of his own money to pay the salaries of the resort’s crews. Gipulan issued to Peralta a check for the corresponding amount, but it bounced

“Another check worth P237,000 dated May 22, 2007 was issued by Gipulan to Peralta as payment for his commission for all the successful events that he brought to the resort was also bounced in October 2007,” Atienza said. Peralta sued Gipulan for estafa with the Olongapo Municipal Trial Court Branch 4. Peralta presented his clearances from the Olongapo City Courts, Zambales courts, police, SBMA and the NBI to prove that he has no derogatory record on file.
