CA asked to put back driver as accused in Subic rape case
THE LAWYER of the victim in the Subic rape case has asked the Court of Appeals to include anew as an accused the Filipino driver of the four US servicemen.
In a petition for certiorari, Evelyn Ursua told the Appeals Court that Olongapo City regional trial court Judge Renato Dilag allegedly abused his discretion when he dismissed the rape charge against Timoteo Soriano.
"He [Dilag] disregarded the findings in the preliminary investigation, which found that Soriano committed overt acts showing his participation," Ursua said.
"Without those acts, the crime would not have happened," she said.
Soriano is the driver of the rented van where the rape of a 22-year-old Filipina in November 2005 allegedly by Lance Corporals Keith Silkwood, Daniel Smith, Dominic Duplantis; and Staff Sergeant Chad Carpentier took place.
