Prosecution will call own gynecologist in rape case
DEFENSE lawyers in the Subic rape case will present a gynecologist today to destroy the testimony of another doctor on the supposed vaginal injuries of the 22-year-old complainant, one of the lawyers said yesterday.
Jose Santiano said Teresita Sanchez would take the witness stand at 1 p.m. as the defense panel’s first expert witness and its third after Lance Cpl. Daniel Smith, the principal accused, and Justin Michael, another accused US marine.
Santiano, counsel for Lance Cpl. Keith Silkwood, said Sanchez would be witnessing for Smith.
Sanchez is expected to dispute the medico-legal examination conducted on the complainant “Nicole” by Rolando Ortiz II of the James Gorden Memorial Hospital in Olongapo City.
Ortiz had testified in court that Nicole had three cuts in her vagina and several bruises on her arms, which he said indicated she had been raped.
His findings were supported by forensic pathologist Racquel Fortun, one of three court-certified expert witnesses presented by the prosecution.
Meanwhile, a women’s group yesterday criticized a justice department prosecutor for his alleged “poor performance” in cross-examining Smith at the witness stand.
In a statement, Kaisa Ka said the prosecutor’s poor showing was part of Justice Secretary Raul Gonzales’ plan to get the US marines acquitted.
Prosecutor Nolibien Quimbao conducted the cross-examination on Smith when he testified Monday, but observers said Quiambao performed poorly and failed to make an impression on Smith.
