ZAMBALES BOARD REVERTS ABOUT P9 MILLION OF ITS OWN BUDGET FOR 2006 TO GOVERNOR’S OFFICE
Iba, Zambales. The provincial board of Zambales during its regular session yesterday in a very rare show of subservience to the executive has unanimously adopted a resolution reverting P8,891,500.00 from its annual budget for 2006 to the office of the governor.
This amount includes the annual budget for 2006 amounting to P1,067,500.00 for various maintenance and other operating expenses of the office of vice governor Ramon G. Lacbain II.
“This move of the provincial board maybe considered a violation of local government code of 1991 particularly section 322 of republic act 7160 because the authority to revert funds is only vested to the local chief executive and the regular presiding officer.
After approving the annual budget of Zambales for 2006 last October 3, 2005 in the fastest way it can in just one session just after few minutes upon submission by the chief executive and without conducting public hearing, the provincial board is also very fast in reverting its own budget to the governor’s office regardless of whether it’s legal or otherwise,” lamented Lacbain whose budget was also reverted to the governor’s office without his consent.
“There were 4 board members who talked to me in my office two weeks ago that they want to transfer the funds of the provincial board including the vice governor to the governor’s office so that it will be easier for them to access the fund when it is realigned to the intelligence fund of the governor. Beside they are also pressuring me to withdraw the case I filed against our board secretary for gross misconduct in office which is now awaiting decision of the supreme court and the court of appeals,” according to Lacbain.
It will be recalled that the provincial board gave vice governor Lacbain for his office a zero budget when they approved the 2005 annual budget of Zambales. It was the board secretary who prepared and submitted the budget of the provincial board for 2005 instead of the vice governor as head of office.
But sometime in August of last year after a series of news stories that is affecting the image of the provincial board, they gave vice governor Lacbain his budget for the remaining 6 months of the year. However when vice governor Lacbain left the country as national leader of the Philippine delegation to the 32nd Ship for Southeast Asian Youth Program (SSEAYP) the acting vice governor turned over to him a remaining budget of P218.73 for maintenance and other operating expenses upon his return last December 20, 2005.
Lacbain said that he will ask the legal opinion of the Department of Interior and Local Government and the Commission on Audit to determine the legality of this action by the provincial board and file appropriate legal action before competent judicial bodies to rectify any wrongdoing and prevent the recurrence of the same.
