Rape case against American Marines finally has a judge

The case against four American Marines accused of raping a Filipina in Subic was raffled off Monday at 1:30 p.m. to Judge Benjamin Pozon of Branch 139 of the Makati Regional Trial Court.
The Makati Trial Court formally received the high-profile case on Friday through executive Judge Sixto Marella Jr. of Branch 138, who ordered the raffle for today.
A 22-year-old Filipino woman was reportedly raped on Nov. 1, 2005, by American Marines Daniel Smith, Keith Silkwood, Dominic Duplantis and Chad Carpentier. They had taken in a joint RP-US military exercise in Subic, Zambales.
The judge originally assigned to the case, Renato Dilag of the Olongapo Trial Court, recused himself on March 23 because his son had worked for the law office of one of the respondents.
A motion to transfer the case was then filed by the Department of Justice to prevent any delay.
It was scheduled to be raffled off to an Olongapo City Regional Trial Court, which has jurisdiction over the Subic Freeport, but the Supreme Court said the Makati Regional Trial Court had a lower caseload.
Pozon, who handled the case for illegal detention against former NBI assistant director Samuel Ong, is on leave until April 17.
