No injury on ‘Nicole’ to show rape or force--witness

THE ABSENCE of bruises on the inner thigh and knees of a Filipina who accused four US Marines of rape indicates that she was not forced into sex, a defense witness told a local court Monday.
“I do not find any injury significant to suggest that there was rape or force,” said gynecologist Teresita Sanchez, whom the defense presented as an expert witness before the Makati regional trial court.
A medico-legal examination report said “Nicole,” a court-appointed pseudonym, had five bruises -- one on her right arm, two on her left arm, and two on her right leg.
Sanchez said that even if “Nicole” claimed to have been drunk when she was allegedly raped inside a moving van in Olongapo City last November 1, she should have sustained bruises on her inner thigh.
“A person who is not cooperating or is dead drunk will certainly have heavy legs. To be able to penetrate, you have to force open the legs,” Sanchez said.
Sanchez said that bruises on the minora labia of the vagina, as in “Nicole’s” case, were “possible on consensual sex.”
“Nicole” was a no-show in Monday’s hearing.
Five public prosecutors whom “Nicole” accused of “incompetence” were present.
The complainant’s mother had accused the prosecution team of pushing for a settlement of the case.
The prosecutors denied this.
Also present in the hearing were Lance Corporal Daniel Smith, the principal accused, and Staff Sergeant Chad Carpentier, and Lance Corporals Dominic Duplantis and Keith Silkwood, co-respondents.
