Subic golf club deal needed deft stroking

In fact, as of end-March, its total arrears, including those with payment schemes, already stood at P37.7 million, in addition to its contested obligations amounting to US$2.12 million and P9.95 million.

“Other violations by—UJGDC/SBGCCI of its Lease Development Agreement [LDA] with SBMA include unfulfilled development commitments since 1996, as well as various violations of labor, health, sanitation and environmental laws.

“It is equally important to note here that SBMA has repeatedly bent over backward to make UIGDC/SBGCC’s business viable, as evidenced by amendments to its LDA on three [3] occasions which provided more lenient provisions but which the group still could and did not comply with.

“The attached Summary of Amendments and Provisions to UIGDC/SBGCC’s Lease Development Agreement will show the substantial assistance and concessions given by SBMA to the group over the years, to which the group responded not only by the continued nonfulfillment to its financial obligations and development commitments but also by filing a groundless lawsuit against SBMA.

“It is also worth recalling that on the day that the notice of termination was to be served, Mrs. Ho arranged a meeting in Manila with the Ambassador, Mr. Filas Chen and the undersigned on the pretext of settling the matter amicably. As it turned out, Mrs. Ho did not even show up in that meeting even as in good faith, the undersigned had to disregard his day’s schedule to rush from Subic to Manila.

“This incident alone verily casts some measure of doubt on Mrs. Ho’s real intent in setting up that that meeting, and the possibility of your good office’s being manipulated or misused for the sake of personal agenda.

“Finally, we wish to assure the Ambassador that the matter between SBMA and UIGDC/SBGCCI is purely a contractual dispute and does not in anyway jeopardize the stability and security of Taiwanese investments in the Freeport, as well as those of hundreds of other investors whose continued trust and confidence we enjoy.

“Thank you and we hope this letter has provided the Ambassador a better appreciation of the matter.

“With renewed assurances of our highest esteem.

The letter received a reply from Ambassador Wu in which he thanked Arreza for “sparing your precious time last June 15, 2007, in receiving my colleagues in your office sharing your assessments and clarifications on the SBMA’s takeover of the management and operations of the Subic Bay Golf and Country Club, Inc. (SBGCCI).

“I also appreciate your letter dated June 18, 2007, explaining the cause and effect of this incident between SBGCCI and SBMA.

“While I expressed our deep concern on the predicament of our Taiwanese locators is the Subic Bay Industrial Park [SBIP] and members of Subic Bay Taiwan Chamber of Commerce [SBTCC], I was deeply impressed by your assistance and efforts rendered to Taiwanese and other locators as well in the SBJP.

“I look forward that the incident between SBGCCI and SBMA can be settled amicably and result in a win-win situation for both sides.”

The effect on other Taiwan locators of the SBMA v. UIG/BGCC case is probably mixed.

A locator wrote Administrator Arreza this letter:

“Dear Administrator Arreza:

“We would like to clarify that our company name was included in the appeal to the President of the Philippines, which was released by the Subic Bay Taiwan Chamber of Commerce on the Philippine Daily Inquirer without our knowledge and consent.

“We sympathize with the Subic Bay Golf and Country Club (SBGCC) in its predicament relative to the take-over of its leased premises by SBMA. However, we are not agreeable to being used by SBGCC in any way in is conflict with you.”

“We are hoping that our company will not be negatively affected by this matter.
