SC dismisses Olongapo sheriff for not paying vehicle rental
The Supreme Court has dismissed a sheriff of an Olongapo City court who did not pay for the vehicles he had rented.
In a 14-page decision, the high court dismissed Ariel P. Pascasio, sheriff III of branch 5 of the Olongapo Municipal Trial Court in Cities, and ordered the forfeiture of all his retirement benefits with prejudice to his re-employment in any branch of the government.
The tribunal said Pascasio violated section 10, Rule 141 of the rules of court for his failure to pay the rental fee for the vans of complainant Virgilio Musngi, owner of V.A Musngi Forwarders, a service contractor accredited with the Subic Base Metropolitan Authority.
"The failure of Sheriff Pascasio to pay complainant Virgilio Musngi the rental for the hauling service is a clear disregard of the Rules. There is no showing that he complied with the rules on estimation of expenses and liquidation of the same," the high court said.
"The authority of the sheriff is broad, but not boundless,” it added. “In the enforcement of judicial orders, a sheriff, as an officer of the court upon whom the execution of a final judgment depends, must necessarily be circumspect and proper in behavior. He must know what is inherently right and wrong and must discharge his duties with prudence and caution. Moreover, he must, at all times, show a high degree of professionalism in the performance of his duties."

Congrats Sir Musngi finally natangal na rin si pascasio sa pagka sheriff napakarami na niyang kalokohang nagawa dito sa ologapo, si pascasio ay isang surot sa lipunan at nakakasira sa samahan ng mga respetadong sheriff ng Olongapo City, nagpapatunay lang na ang ating lungsod ay di pinapayagan ang isang tulad niya na ginagamit ang posisyon para mang abuso ng tao. I salute you supreme court for the job well done. Salamat po at nilinis ninyo ang departamento ng sheriff III of branch 5, Olongapo.
