Gordon Hits Martial Law

as Historic session begins

AT exactly 4:12 p.m. yesterday, the House of Representatives and the Senate officially started the historic session to discuss Presidential Proclamation 1959 which placed Maguindanao under martial law.

There were 192 representatives and 18 senators in the session presided by Speaker Prospero Nograles and Senate President Juan Ponce Enrile.

Senators Lito Lapid and Pia Cayetano failed to attend.

Executive Secretary Eduardo Ermita, Justice Secretary Agnes Devanadera, Interior and Local Government Secretary Ronaldo Puno and National Police Director General Jesus Verzosa were present to defend martial law.

Sen. Richard Gordon made an issue on the absence of Defense Secretary Norberto Gonzales and Armed Forces Chief Victor, saying their absence shows that martial law is not needed.

“Sila ang kinatawan ng pamahalaan para sagutin ang issue. Lumalabas dito na bale wala ang martial law and everything is under control. Lumalabas din na mahina ang kaso ng gobyerno kasi pinababayaan na lumabas sila ng bansa sa gitna ng issue,” Gordon said.

Nograles expects the session to last until next week. By: Jester P. Manalastas - People's Journal

Mitos brings power co-ops feud to Congress

The “turf war” between the National Electrification Administration and Cooperative Development Authority over management control of thousands of electric cooperatives nationwide has reached Congress.

During a House committee hearing yesterday, Zambales Rep. Milagros Magsaysay castigated NEA for refusing to give up management control of electric cooperatives that are now registered with the CDA, which is empowered by law to supervise them.

“Instead of interfering and wasting your time squabbling with the CDA on the day-to-day operations of electric cooperatives that decided to register with the CDA, NEA should instead concentrate on its primary task of providing technical expertise and funding to villages that are lacking electricity nationwide,” Magsaysay said at the hearing conducted by a House committee chaired by Apec Rep. Ernesto Pablo.

Magsaysay gave NEA administrator Edith Bueño a dressing down for meddling in the board composition of the Zambales Electrical Cooperative (Zameco)-II, which is now registered with the CDA as mandated by Republic Act 9520, also known as “The Philippine Cooperative Code of 2008.”

The law empowered CDA to supervise management of thousands of cooperatives nationwide.

“Why did you decide to extend the term of the interim board by another 180 days when you knew for a fact that Zameco II has already registered itself to the CDA and the enabling law has become effective by Feb. 19, 2009?” Magsaysay asked Bueño.

Republic Act 9520 is expected to strengthen the thousands of cooperatives in the country and enable the system to contribute to the country’s economic growth, according to Magsaysay.

Bueño said there was a “clamor” from Zameco II’s stockholders that prompted her to intervene and prevent a possible disruption of power service in the area should the protests worsen.

“Did you verify that the rallyists were really stock members of Zameco II?” Magsaysay asked. Bueño could not answer.

The congressional inquiry was prompted by Magsaysay’s filing of House Resolution 1098, which sought to investigate the alleged abuse of authority of and interference by the NEA on electric cooperatives registered with the CDA.

Magsaysay said she filed the resolution after receiving complaints from electrical cooperatives in Zambales, Bataan and Batangas alleging that NEA is interfering with their management operations.

“Some of the perceived offenses being raised by the electrical cooperatives include brazen appointments of pro-NEA board members in the cooperatives board and refusal of the agency to release their cash incentive,” Magsaysay said.

Also during the hearing, CDA oversight administrator retired Judge Fulgencio Vicario said the CDA could assume supervision of all 17 electric cooperatives that decided to leave NEA and switch on its side by July 1.

Electric cooperatives decided to register with the CDA after the latter assured them that no taxes would be levied against them as part of their incentives.

But the electric cooperatives would have to wait for another three months while the system is being fine-tuned, Vicario said.

Magsaysay then asked Bueño whether NEA will again interfere in the choosing of Zameco II’s board once the interim board expires in September.

“No your honor, it is not in NEA’s business to stay in places we are no longer wanted,” Bueño said. NEA last May extended the term of Zameco II’s interim board by another 180 days.

Bueño also assured lawmakers and the CDA that her agency will do its best in expediting the release of funds needed by electrical cooperatives’ various electrification projects.

“So those promises are a scout honor’s?” asked Magsaysay, to which Bueno replied in the affirmative.

For his part, Apec Rep. Edgar Valdez also advised NEA and CDA administrators to sit down and settle their differences.

Bueño and Vicario agreed that it was quite clear that all cooperatives in the country are effectively under CDA control, except in cases when these cooperatives have outstanding loans with the NEA.

Valdez also discouraged the two agencies from suing each other since the court battle is “time consuming and [costly] for all concerned.” By Christine Herrera - Manila Standard Today

“Plastic bags littered along roadside drains cause street flooding during heavy rainfall. Plastic wastes likewise kill one million sea birds, 100,000 sea mammals and countless fish every year,” paliwanag ni Bichara.

Nabatid kay Bichara na ganap na ipinagbawal o ikinakampanyang huwag gamitin ang plastic bags sa Australia, China, Ireland, Bangladesh, Paris, Italy, Taiwan at Tanzania. “The Philippine government has a duty to protect the national environment and take an active role in safeguarding the health of its citizen to combat the pernicious effects of the wanton destruction of our natural resour-ces,” ani Bichara.

Sinabi ni Bichara na dapat ilagay ang lahat ng pondong malilikom sa panukala sa taunang pondo ng Department of Environment and Natural Resources (DENR).

“A person’s use of plastic bags may be counted in minutes but a plastic bag takes between 15 to 1,000 years to be broken down by the environment,” ani Bichara. By Ryan Ponce Pacpaco - Journal Online

Magsaysay chide JDV over ‘threat’ to testify in Senate ZTE probe

Zambales Rep. Milagros “Mitos" Magsaysay said De Venecia's move to announce his intention to testify appears as if he was trying to strike a deal with the government

Several lawmakers on Monday criticized former House Speaker and Pangasinan Rep. Jose de Venecia over pronouncements that he intends to testify before the Senate panel investigating the controversial national broadband network deal with ZTE Corp.

Some of De Venecia's colleagues at the House of Representatives said the former Speaker lacks credibility to back up whatever testimony he will be giving the Senate, while others called De Venecia's pronouncement a "bluff."

Palawan Rep. Abraham Mitra, son of the late Speaker Ramon Mitra with whom De Venecia had a tiff with in 1992, said De Venecia will only appear to be sour-graping from his ouster as House Speaker.

"JDV does not have any credibility anymore. Everything he says will just come out as sour-graping. Why didn’t he speak up when he was still Speaker?" Mitra said.

For his part, Cavite Rep. Elpidio Barzaga Jr called De Venecia's "threat" to testify before the Senate a "bluff," saying he will similarly fail in delivering the "knockout punch" which his son and namesake failed to deliver when he testified on the controversial deal.

"If the son who was in the midst of it failed to give the knockout punch, how can the father who was far away from it succeed this time? JDV is giving too much credit for himself. If he thinks he can bring down the government, then he is now believing in his own propaganda. His record in arousing the people is, however, dismal," Barzaga said.

"He can’t get the people to elect him President (in 1998), so what gives him the confidence that with him leading the charge they will help him unseat the current one?" the lawmaker asked

Another colleague at the Lower House, Iloilo Rep. Janette Garin who was among the few lawmakers who voted to keep De Venecia in the speakership battle last February 4 said the issue would still boil down to vested interests.

Garin also questioned De Venecia's intentions in coming out only now, saying the issue has been on the table for a long time.

The lawmaker noted that it is glaring that De Venecia's son Joey lost the NBN contract.

"His affiliation as a father of a bidder would question his credibility. Testifying on the accusations against the present administration, I cannot really see and say that he (JDV) is very credible," Garin said.

"We have questions in mind. What he is up to? Why only now? And third, up to what extent is his involvement? Because a credible witness will come out as somebody who would really like to clear the issue and not somebody who has business vested interest on it," Garin said.

Meanwhile, Bacolod City Rep. Monico Puentevella, welcomed De Venecia’s threat, saying: "If he wants to commit hara-kiri, then he should go for it. He will be the first to go down although on second thought, he’s already down."

Puentevella said "vengeance" for his ouster as House Speaker is likely De Venecia's motive.
"Hell hath no fury than a powerful man scorned. It is not truth that is motivating him but most probably vengeance. It is of public knowledge that he has some scores to settle," Puentevella said.

For Zambales Rep. Milagros “Mitos" Magsaysay, De Venecia's move to announce his intention appears as if he was trying to strike a deal with the government.

“By so much drumbeating, this has led many to wonder that by firing warning shots, what JDV really wants is to cut a deal with Malacañang. By threatening war, maybe he wants a ceasefire, for himself and for his son," Magsaysay said.

“I wish the former Speaker will stop coming out with teasers. He is only making the situation worse because he will comment but refuse to divulge. If there is indeed anything to divulge," she added. - GMANews.TV

Anti-smuggling chief shows up at House probe

Amid threats of subpoena and arrest, the beleaguered head of the Presidential Anti-Smuggling Task Force Group (PASG) finally showed up on Wednesday at the House of Representatives investigating the alleged rampant smuggling in the country.

PASG chief Antonio Villar had repeatedly snubbed the inquiry being conducted by the committee on good government and had even threatened to resign his post, accusing some legislators of harassment.

But this did not stop the House from insisting on Villar's presence in the inquiry that even Speaker Prospero Nograles expressed readiness to sign a subpoena to compel the official's attendance in the hearing. By Maila Ager - INQUIRER.net

Solons to go to US to press passage of law on RP war vets

The Filipino legislators, led by Zambales Representative Antonio Diaz, chair of the House committee on veterans' affairs, are due in Washington on April 12
A group of Filipino lawmakers are preparing to leave for the United States to lobby for the passage of the Filipino Veterans' Equity Bill in the US Congress.

Muntinlupa Representative Rufino Rozzano Biazon said the bill, which could provide up to $90 million a year to some 18,000 surviving Filipino veterans of World War II, is up for floor debates in the US Congress.

"But being an election year, we are hoping that Americans of Filipino ancestry -- estimated at about four million -- will make themselves felt so that candidates and parties will not just ignore us," said Biazon, vice chair of the House committee on national defense.

The Filipino legislators, led by Zambales Representative Antonio Diaz, chair of the House committee on veterans' affairs, are due in Washington on April 12. They will meet key American legislators and call on an estimated four million Americans of Filipino ancestry to help push the bill.

Biazon said he is joining the team together with Pasig Representative Roman Romulo, Undersecretary Ernesto Carolina of the Philippine Veterans' Affairs Office and a representative from the Veterans' Federation of the Philippines.

"It's a 50-50 chance for us. But we have to hope that it will pass," Biazon told the Philippine Daily Inquirer. "We have supporters in the US (House) and Senate who will help."

The veterans equity bill, which would give Filipino veterans the same benefits as their American counterparts, was introduced by Hawaii Senator Daniel Inouye in the US Senate and by California Representative Bob Filner in the US House.

In a report, the Office of the Veterans Affairs at the Philippine Embassy in Washington described the veterans as in their mid 80s with "very poor access to health care and dying at the rate of 10 percent." By 2015 all the veterans would have passed away, it said.

With National Heroes Day on the calendar next week, Biazon said it was only right to give the lobby effort their best shot.

"To not even try to have it passed is to ignore the sacrifices our veterans made for this country," Biazon said. By Norman Bordadora - Philippine Daily Inquirer

Lawmakers want Spratlys debate

Two legislators urged the House leadership to elevate the debate on the controversial Spratly Islands to the plenary, instead of sending a bill about that issue back to committee. Muntinlupa Rep. Ruffy Biazon and Zambales Rep. Milagros Magsaysay agree that questions surrounding the Spratlys must be tackled on the floor, if lawmakers are to settle the issue once and for all.

Biazon said he wants to take up the accusations made about the Joint Marine Seismic Undertaking signed by China, Vietnam and the Philippines and the alleged link between that agreement and Chinese loans to this country.

For her part, Magsaysay said House Bill 3216 or Defining the Archipelagic Baselines of the Philippines is now on third reading.

“It is unfair to refer it back to the committee,” Magsaysay said. “It [the plenary] is the only venue for non-members to raise our voices. Hence, it should be brought to the floor.”

Neither Biazon nor Magsaysay is a member of the Committee on Foreign Affairs of the House of Representatives, the panel handling initiatives about the Spratlys.

House Resolution 496 was filed recently by Bayan Muna Party-list Rep. Teodoro Casiño, who was inquiring about delays faced by House Bill 3216.

Casiño said he was told by Committee on Foreign Affairs Vice-Chairman Orlando Fua that an official from the Department of Foreign Affairs had called him about suspending the passage of the bill, because it will affect treaties entered into by the government with the Chinese. He added that Fua refused to name of the department official he had talked to and to disclose details about their conversation.

The Philippines has only up to May 2009 to file its claim to the Kalayaan Island Group, which is in the disputed Spratly Islands. The claim is to be submitted to the United Nations Convention on the Law of Sea (Unclos).

There are six countries claiming the Spratlys in part or in whole—China, Vietnam, Philippines, Taiwan, Brunei Darussalam and Malaysia. By Jomar Canlas - Manila Times
